Detained fast track unfair for vulnerable woman

The Home Secretary has conceded that the decision to detain a woman with a history of domestic violence in the detained fast track process at Yarl’s Wood in 2013 was unlawful.

The claimant was represented by Bhatt Murphy and Stephanie Harrison QC of Garden Court Chambers.

The case follows a number of judgments which found the detained fast track process to be unlawful. The Home Secretary has agreed to reconsider the claimant’s asylum claim and pay damages. For further information, see our briefing note, letter which led to settlement and final order.
