The challenge was to the rationality of the Secretary of State’s decision that AA did not fall under the Afghan Relocations and Assistance Policy (ARAP) as an Additional Family Member. Though the Secretary of State maintained his decision, two days before the full hearing he agreed to grant AA indefinite leave to remain outside the rules.
Of note are general directions made by Swift J in relation to the conduct of the Secretary of State in ARAP related High Court cases involving closed material procedure. The Secretary of State has appealed that part of the decision.
