Home Office failed to tell the truth about reason for asylum seeker’s detention

In a judgment handed down today, a High Court judge has held that an asylum seeker was unlawfully detained because the Home Office failed to give true or accurate reasons for his detention.

The claimant was detained less than one month after he was granted bail by a First-tier Tribunal judge. The judgment provides important guidance on the circumstances in which it may be unlawful to detain a migrant following a judge’s decision to grant bail. The Home Office also dismissed reports from two detention centre doctors that expressed clinical concerns that the asylum seeker may be a survivor of torture.
