Home Secretary breached child refugee’s rights

The Upper Tribunal has ruled that the Home Secretary breached the rights of an asylum-seeking child from Eritrea. The child’s application to join his brother in the UK was refused in an expedited process set up after the demolition of the Calais ‘jungle’.

The Tribunal quashed the Home Secretary’s decisions and held that the continuing failure to admit the applicant is unlawful. A copy of the judgment can be downloaded here.
