Caleb’s Notable cases

Public Inquiry into the Covid-19 Pandemic

Caleb is part of the team representing a number of Disabled People’s Organisations granted Core Participant status in the Public Inquiry into the Covid-19 Pandemic. The Modules we are instructed on are considering decision-making and political governance, the vaccine and therapeutics programmes, and the care sector during the pandemic.

R (Liberty) v Secretary of State for the Home Department and Secretary of State for Foreign and Commonwealth Affairs

Caleb is assisting Shamik Dutta, in representing the national campaign group ‘Liberty’ in its ongoing challenge to the covert surveillance measures contained in the Investigatory Powers Act 2016 (also known as ‘the Snooper’s Charter’). Read more on Liberty’s website here.

S v Commissioner of Police for the Metropolis

Caleb assisted Shamik Dutta in acting for a client whose vehicle was seized by officers of the Metropolitan Police following a failure to correctly apply the relevant legal guidance. The claimant pursued claims including trespass to property and race discrimination. The case resulted in financial compensation and a formal apology being provided to the client.

M v Commissioner of Police for the Metropolis

Caleb assisted Shamik Dutta in securing compensation for a client who was stopped and searched by officers of the Metropolitan Police. It was our client’s position that race discrimination contributed to both the decision to stop our client and the force used upon him.

PQ & others

As a trainee solicitor Caleb assisted Eva Roszykiewicz in acting for two black 16 year old boys and other family members in an ongoing IOPC investigation and proposed civil claim arising out of an incident involving Met officers in June 2022. The incident received national media attention following the circulation of a shocking video on social media which shows officers repeatedly punching one of the boys, including articles in the Daily Mail, The Mirror, the Independent, and the Sun.

AUS v R [2024] EWCA Crim 322

As a trainee solicitor Caleb assisted Colin Gregory acting for a Somali refugee who was sentenced to 1 year imprisonment for using a false ID in 2010. The Court of Appeal quashed her conviction because she had used the ID to seek asylum. If she had been advised about the ‘refugee defence’ by her former criminal solicitors, the defence would have likely succeeded. Instead, our client pleaded guilty without receiving proper advice and her resulting conviction was an injustice.

DJ v Commissioner for the Metropolitan Police

As a trainee solicitor Caleb assisted Tony Murphy in acting for DJ, a 13 year old boy who was detained by police officers whilst wearing school uniform. The incident resulted in an ongoing IOPC investigation and proposed civil claim. The IOPC investigation has led to gross misconduct charges against two of the officers and has received considerable media attention including from Sky News.
