KXJ, a trans woman prisoner, has succeeded in a judicial review against the prison service arguing that the process to decide her treatment and allocation in prison was unfair.
KXJ challenged in the Administrative Court the refusal of the prison service to provide her with advance disclosure of information relied upon in the decision making process to determine her allocation in a male or female prison. She argued this breached her rights under Article 8 ECHR and the common law. After bringing court proceedings advanced disclosure was provided and the claim was settled by the prison service.
