Court of Appeal finds the Home Office discriminated against immigration detainees

The Court found that the Home Office had discriminated against the Appellants ASK and MDA under the Equality Act 2010 by failing to make reasonable adjustments for their mental health conditions.

We are now calling for the Home Office to take urgent steps to protect the rights of migrants with mental health conditions.

ASK is represented by Jane Ryan of Bhatt Murphy with Stephanie Harrison QC of Garden Court Chambers and Leonie Hirst of Hirst Chambers. MDA is represented by Sue Willman of Deighton Peirce Glynn, with Amanda Weston QC of Garden Court Chambers and Leonie Hirst of Hirst Chambers.
