Court of Appeal quashes our Somali refugee client’s conviction for possessing a false identity document

Our client was sentenced to 12 months’ imprisonment in 2010 for using a false ID. The Court of Appeal found that our client’s former criminal defence representatives failed to advise her about the ‘refugee defence’ under s31, Immigration and Asylum Act 1999. Her conviction was quashed because she pleaded guilty without receiving proper advice.
